A popular Crewe restaurant and bar has appealed against a licensing decision - preventing them from serving alcohol.
Swish Lounge, Mill Street, has appealed against Cheshire East Council's decision to revoke its premises licence and can continue to serve alcohol until the appeal is decided.
Cheshire East's licensing sub-committee decided to revoke the licence because staff allowed customers to smoke shisha pipes in an enclosed rear area - separate from the restaurant.
A hearing was held on December 6 after the council's commercial services team reported repeated breaches of the Health Act - where the pipes were smoked.
The decision to revoke the licence was published at the beginning of this month (January), but the council has confirmed the Crewe restaurant can still continue to operate as normal.
This included serving alcohol – until a decision is made at appeal.
Swish Lounge serves a range of cocktails and beers alongside its Turkish/Mediterranean food .
It also serves a wide variety of grilled lamb and chicken served on skewers, in kebabs and in fajitas.
Mr Anik Jnr, son of owner Abdullah Anik, told the Local Democracy Reporting Service he wanted to make it clear the business is still operating as normal.
During the December hearing, Briona Turner, from the council's commercial services team, told the committee there were at least nine occasions where she was aware of legislation breaches.
Mr Anik Jnr said there had been a misunderstanding around the complexities of the licence and the rules.
He had asked if there was a shisha licence and when told there wasn't, he asked how it could be revoked.
Mr Anik Jnr said Swish Lounge is a Turkish restaurant providing 10 jobs and the shisha area is just for the rear garden.
He said: "I believe that it will be very unfair to revoke the full licence, when there's a restaurant operating in the front side which is totally separate from the rear area.
"And having been told that there's no shisha licence, I believe there's nothing to revoke."
Swish Lounge opened in August 2021 and is open 12pm to 11pm Monday to Sunday.
