Sentence for van driver who killed 23-year-old Crewe pedestrian will not be reviewed

A van driver who killed 23-year-old Joshua Spender will not have his sentence reviewed - despite calls from the Crewe MP.

In May, William Bratton of Market Drayton, was sentenced to seven years in prison after his dangerous driving killed the Crewe man.

The 30-year-old hit Joshua Spender on November 5, as he made his away across a pedestrian crossing on Macon Way - he died shortly after in hospital from his injuries.

This month, Crewe and Nantwich MP, Dr Kieran Mullan, wrote to the Attorney General (chief legal advisor to the Crown) - asking her to review the sentence of Bratton.

Dr Mullan posted on social media, saying: "I know many people beyond just his family were deeply upset about the killing go local man Joshua Spender.

"The Loss for Joshua's family has of course been devastating. I didn't know Josh but we can all imagine what it would be like to suffer the loss of a family member in this way.

'There is a petition locally asking for the sentence for his killer to be reviewed.

"After consulting with Joshua's family I have written to the attorney general asking her to review the sentence to see if it can be referred to the Court of Appeal as unduly lenient."

Yesterday (June 20), the Attorney General said the case did not meet the threshold to be referred to the Court of Appeal.

Following the decision, the Crewe MP updated constituents on social media, saying: "Unfortunately Bratton's appeal will not be reviewed by the Court of Appeal.

"I know Joshua's family are hugely grateful for the support everyone has shown and always knew it was a long shot.

"Sadly, we can't get proper justice in this case but we have to keep pushing for reform so more people in future do."

The Unduly Lenient Sentences scheme enables people to ask for a review in cases where they believe the sentence given is too low.

Unfortunately, Dr Mullan's letter was not successful in securing a review of the sentence.

For his seven-year sentencing, Bratton appeared at Chester Crown Court on Friday (May 13).

He pleaded guilty at an earlier hearing to causing death by dangerous driving.

The man was banned from driving for ten years which will begin when he is released from prison.

Following the sentencing in May, Joshua's family said: "On the 5 November 2021 our lives were changed forever.

Bratton was initially arrested at an address in Market Drayton on November 7. He taken into custody and subsequently charged (Cheshire Constabulary).

"We have all been left broken, utterly devastated by the sudden and avoidable loss of our wonderful son, grandson, brother and friend to many.

"We have all been left with such an overwhelming sadness and such helplessness."
