Crewe court hands man driving ban after failing to provide breath sample
Crewe Magistrates' Court has banned a Cheshire man from driving - after he failed to provide a breath sample following an incident last year.
Daniel Burke, of Macclesfield Road, Wilmslow, pleaded not guilty at Crewe Magistrates Court on Thursday 16 March.
The 32-year-old was charged with failing to provide a breath sample at Middlewich Custody Suite on Saturday 30 July, 2022.
After listening to the evidence, Crewe Magistrates' found Burke guilty last month.
Burke was brought back to the Crewe Court on Monday 3 April after a pre-sentence report had been prepared.
The Wilmslow man had been given an interim disqualification from driving and remanded on unconditional bail.
After reading a pre-sentence report, Crewe Magistrates' gave Burke a community order.
The 32-year-old was ordered to complete unpaid supervised work for more than 90 hours within the next 12 months.
Burke was disqualified from holding or obtaining a driving licence for the next 18 months.
The defendant was also ordered to pay a £640 costs and a £114 victim surcharge.
Crewe Magistrates have given Burke until Wednesday 3 May to pay this £754 court penalty.
